Applies to: the CubeX app for Android (package name com.gyntheticlabs.cubex) and the CubeX website at https://cubex.g-ynthetic-labs.com.
CubeX is published by G-ynthetic Labs ("we", "us"). By installing or playing CubeX you agree to these terms. If you do not agree, do not install it.
1. Who can use CubeX
You must be 13 or older, or the higher minimum age set by the law where you live. CubeX is not directed to children and is not part of Google Play's Families programme.
If you are under the age of majority where you live, you may use CubeX only with a parent or guardian who accepts these terms for you.
2. Your licence to use the app
We give you a personal, non-exclusive, non-transferable licence, which we may withdraw, to install and play CubeX on devices you control, for your own non-commercial use.
You may not:
- copy, sell, rent, sublicense or redistribute the app;
- reverse engineer, decompile or disassemble it, except where the law expressly
allows it, and only within those limits;
- remove, hide or interfere with the ads;
- get around the subscription, or unlock paid content without paying for it;
- use it to break the law, or to attack, disrupt or overload any system.
The app is licensed to you, not sold to you. We keep every right we do not expressly give you here.
3. Your account
You sign in to CubeX with your Google account. Your account shows which plan you are on, and lets your subscription follow you to another phone.
Your progress is stored on your device. We cannot see it, and we cannot restore it: if you clear the app's data or uninstall the app, that progress is gone.
You are responsible for what happens on your account. You can delete it at any time from the Support part of the app's Account window, as described in the Privacy Policy. We may suspend an account that is used to break these terms, and will tell you why if we do.
4. Plans: Free and the subscription
CubeX has two plans.
Free. Free to play, supported by ads served by Google AdMob. On the Free plan you pick one of the three campaigns (Gambler, Strategist or Rebel) and play it in full, along with the Gym and Learn. Lore and achievements are not included.
Subscription. $9.95 a month, or the price Google Play shows in your currency before you buy. It adds the other two campaigns, the lore and the achievements, and removes the ads.
If you are in the EEA, the UK or Switzerland, you are asked for consent before any ad loads, and you may decline. Declining does not take anything away from the game.
How the subscription works
- It is sold and billed by Google Play, under Google Play's terms.
- It renews automatically every month until you cancel. Google Play charges
the payment method on your Google account at each renewal.
- You can cancel at any time in **Google Play, Payments and subscriptions,
Subscriptions**. When you cancel, you keep the subscription until the end of the month you have paid for, and it does not renew.
- Uninstalling the app or deleting your account does not cancel the
subscription. Cancel it in Google Play.
- If we change the price, Google Play tells you before the new price applies, and
you can cancel before it does.
Refunds. Refunds are handled through Google Play's refund policy (https://support.google.com/googleplay/answer/2479637). If something has gone wrong with your subscription, email us as well. Nothing in these terms limits any right to a refund or withdrawal that your local consumer law gives you.
How ad, account and purchase data are handled is described in the Privacy Policy.
5. In-game progress and items
Campaign progress, your AI cores and what they have learned, Gambits, lore, achievements and every other in-game item exist only inside the game. They have no money value, cannot be exchanged for money, and cannot be transferred.
We may change, rebalance or remove in-game systems as the game develops. We will avoid needless changes to progress you have earned.
6. Things you create
The loadouts you build in the Gym and the way you coach your cores are yours. They stay on your device, we do not receive them, and we claim no rights in them.
Your cores adapt to the games they play, so they will not always play the same way, and a loadout may do better or worse as the game is rebalanced.
If you send us feedback, a bug report or a suggestion, you allow us to use it to improve CubeX without owing you anything for it. You give up no other right by doing so, and we will not publish your name without asking.
7. What we own
CubeX, including its code, its engine, its artwork, its piece designs, its story, its text and the name "CubeX", belongs to G-ynthetic Labs and is protected by copyright and other laws. Playing the game gives you no ownership of any of it.
The app also includes open-source software that belongs to its authors and is used under its own licences. Those licences, not these terms, govern that software, and nothing here limits the rights they give you. It is listed at https://cubex.g-ynthetic-labs.com/licenses.html.
8. Availability
The game runs on your device. If our website or Google's services are unavailable, sign-in and buying or checking the subscription wait until they are back.
We may update the app, change how it works, or stop publishing it. If we withdraw it from Google Play, we will stop selling new subscriptions and stop renewals.
We do not promise the app is free of defects, or that it runs on every Android device or every version of the Android System WebView. The app needs WebGL.
9. Warranties and liability
CubeX is provided "as is", without warranties of any kind, as far as the law allows.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you in connection with the app is limited to the greater of US$100 and the amount you paid for the subscription in the 12 months before the claim.
If you are a consumer, you keep every right your local consumer law gives you.
10. Changes to these terms
We may update these terms. If a change materially affects you, we will update the date above and tell you in the app before it takes effect. Continuing to play after that means you accept the new terms.
11. Law and disputes
These terms are governed by the laws of the State of Oregon, USA, and the courts there have jurisdiction. If you are a consumer in the EEA, the UK, or another place whose law lets you bring proceedings locally, you keep that right and the protection of your own country's mandatory consumer law.
Before starting formal proceedings, please email us. Most problems are a misunderstanding, and we would rather fix it.
